Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cesmova platform and related services ("Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Cesmova provides software for automotive dealerships to qualify leads through an AI chatbot, create and manage advertising campaigns on connected Meta (Facebook and Instagram) assets, and manage their sales pipeline. The Service is provided on a business-to-business basis to dealerships and their authorized users.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

3. Connected advertising accounts

When you connect your own Meta Page and Ad Account, you authorize Cesmova to create and manage advertising on your behalf using those assets. You remain the owner of your ad account and are responsible for all advertising spend billed by Meta, for the content of your ads, and for compliance with Meta's policies and applicable law. By default, campaigns are created in a paused state for your review before they run.

4. Acceptable use

You agree not to use the Service to:

• violate any law, regulation, or third-party right;
• publish misleading, deceptive, or prohibited advertising content;
• upload malware or attempt to gain unauthorized access to the Service or other accounts;
• interfere with or disrupt the integrity or performance of the Service;
• process personal data of your leads other than for legitimate dealership sales purposes.

5. Customer and lead data

You are the controller of the lead and customer data you collect through the Service, and Cesmova processes it on your behalf to operate the Service. You are responsible for handling that data lawfully, including obtaining any required consents. Our handling of personal data is described in our Privacy Policy.

6. Intellectual property

The Service, including its software, design, and content (excluding your data and your ad content), is owned by Cesmova and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not guarantee any specific advertising results, lead volume, or sales outcomes.

8. Limitation of liability

To the maximum extent permitted by law, Cesmova will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for advertising spend, lost profits, or lost data arising from your use of the Service.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that creates risk or legal exposure. Upon termination, your right to use the Service ends; data deletion is handled as described in our Privacy Policy.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
